Participation agreement

When the new Mineral law was being discussed in Mongolian Parliament, CHRD lobbied several MPs to include positive provisions for local community participation, such as an agreement that could be concluded among mining companies, local authorities and communities living in mining affected area. As a result of this lobbying, public participation agreements were provided for in Article 42 of the Mineral law. This kind of agreement is variously called a Participation agreement, Community benefit agreement and Investment agreement.

During the first week of May 2010, CHRD hosted a conference for community members, local authorities and mining companies who have concluded participation agreements. The purpose of the conference was to evaluate the success of the agreements, discuss issues and problems which have arisen, and propose ways in which the process of negotiating participation agreements can be improved so that they play a more effective role in promoting responsible mining in local areas.
